This is a pre-filled review draft based on the platform currently implemented. The operator name and registered address have been inserted; required licensing information and the final legal wording must still be reviewed before launch.
1. Agreement and scope
These Terms govern access to the DaoJoy website, traveler application, guide application and related booking, communication, safety, content and support services. The contracting platform operator is DaoJoy LLC, registered address: China Jiangsu Nanjing. By creating an account, accepting the current policy set, submitting an inquiry or confirming a booking, you agree to the version presented to you.
The Privacy Notice, Community and Content Guidelines, Refund and Cancellation Policy, order confirmation, proposal and any service-specific terms form part of the agreement where applicable. Mandatory rights under consumer, privacy and other applicable laws are not excluded by these Terms.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into the relevant agreement. An adult may arrange travel for a minor only with proper authority and remains responsible for the minor’s supervision and information.
You must provide accurate, current and complete information, keep sign-in methods and devices secure, and promptly report suspected unauthorized access. One person may not impersonate another, sell an account or use an account for unlawful activity. DaoJoy may require recent identity verification for sensitive actions such as account deletion.
3. Platform and participant roles
DaoJoy provides tools to discover services, submit inquiries, receive proposals, make bookings, communicate, coordinate trips, process payments and refunds, and obtain support. The applicable operator disclosure, order or proposal identifies the service scope, price, guide arrangement and the party responsible for performance. A guide’s employment, agency, independent-service or other legal status depends on the applicable agreement and law; these Terms do not recharacterize that relationship.
DaoJoy does not provide government, immigration, medical, legal or emergency-response services. It does not guarantee visas, weather, transport operations, third-party venue access or outcomes outside the agreed service. Official emergency services should be contacted first where life, health or immediate safety is at risk. In mainland China, the public emergency numbers include 110 for police, 119 for fire, 120 for medical emergencies and 122 for traffic incidents; elsewhere, use the applicable local number.
4. Inquiries, proposals and bookings
An inquiry is a request for assistance and is not a booking. A recommendation or AI-assisted draft is not an offer or confirmation; only a formal proposal released through the applicable travel-advisor-reviewed publication flow may be accepted during its stated validity period. A booking is formed when the application confirms acceptance and any required payment has been successfully completed, subject to mandatory law and the specific order flow. A standard direct booking may temporarily hold availability while payment is pending; an expired or failed hold does not create a confirmed booking.
Before confirmation, review the service description, dates, destination time zone, meeting arrangements, inclusions, exclusions, price, payment schedule and cancellation terms. Correct input errors before payment. Changes requested after confirmation are effective only when accepted in the application or in a written DaoJoy support record.
5. Prices and payment
Prices are displayed in the currency stated in the proposal or order. The current product settles service amounts in USD; any reference-currency display is informational and may differ from the rate used by your bank or payment provider. Taxes, tips and third-party costs are included only when the order expressly says so.
Unless the accepted order states otherwise, a customized service uses a 30% deposit and 70% balance; when the service begins fewer than seven days after confirmation, full payment may be required at confirmation. A standard direct booking requires full payment. The applicable amount, payment window and due date are shown before confirmation and preserved in the order record. Payment is processed by an authorized payment provider. You must use a payment method you are authorized to use and must not initiate an improper chargeback instead of using the available support and dispute process.
6. Traveler responsibilities
Travelers must provide timely and truthful trip information; disclose mobility, accessibility or safety needs that are material to the requested service; arrive at the agreed place and time; follow lawful safety instructions; respect guides, communities, venues and local customs; and pay amounts due. Travelers remain responsible for passports, visas, insurance, health decisions, transport to the meeting point and personal belongings unless the order expressly provides otherwise.
7. Guide responsibilities
Guides must maintain truthful profiles, required qualifications and availability; accept only work they can lawfully and safely perform; protect traveler information; follow the confirmed itinerary and service scope; communicate delays or hazards promptly; avoid unauthorized substitutes and off-platform payment requests; and use the platform cancellation flow if unable to perform. Guides must comply with applicable licensing, tax, safety and professional obligations.
8. Communications, safety tools and AI assistance
Trip messaging is not end-to-end encrypted. Access is limited to trip participants and authorized personnel who need it for service, safety, moderation, support or disputes, and access may be audited. Push notifications may omit full message text.
Location sharing requires an express user action and is limited to an active trip. SOS and safety tools supplement, but never replace, official emergency services. AI-assisted proposals, translations, menu analysis and trip-recap drafts may be incomplete or wrong. Users must verify important safety, medical, allergy, price, address and booking information with a qualified person or the original provider.
9. Content and conduct
You retain ownership of content you lawfully submit. You grant DaoJoy a non-exclusive, worldwide, royalty-free license to host, reproduce, translate, format and display that content only as reasonably necessary to operate, secure and improve the requested service and, for content you choose to publish, to distribute that public content until it is withdrawn. This license does not permit DaoJoy to sell private trip content or use private chat text to train general-purpose models.
You must follow the Community and Content Guidelines and must have rights to anything you upload. DaoJoy may investigate reports and may warn, restrict, hide, remove or preserve content, or suspend an account, where reasonably necessary to enforce the agreement, protect safety, comply with law or preserve evidence. Where available, an affected user may use the stated appeal process.
10. Cancellation, refunds and disputes
The Refund and Cancellation Policy shown before confirmation applies unless the order contains a more specific lawful term. DaoJoy preserves the applicable numerical policy, destination time zone and price components in the order snapshot so a later policy change does not alter an accepted booking.
Cancellation requests must be submitted through the in-app flow or the support path identified for the order. A request may enter review and is not final until the application records the decision. Refunds are returned through the supported original-payment process. Provider processing time and currency conversion are outside DaoJoy’s direct control. Statutory remedies and rights for non-performance, misrepresentation, force majeure or personal injury remain available where applicable.
11. Suspension and account deletion
DaoJoy may restrict content or features, suspend an account or terminate access for material or repeated breach, fraud, threats, unlawful conduct, safety risk, payment abuse or legal requirement. Where practicable, we will state the reason and available review path. Immediate action may be taken where delay could expose a person or the service to harm.
You may request account deletion after identity verification. New inquiries and bookings stop immediately. If open orders, refunds, support matters or payouts remain, access necessary to resolve them continues and deletion completes afterward. Deletion does not cancel existing payment, record-retention, safety, dispute or legal obligations.
12. Intellectual property
DaoJoy’s software, interface, trademarks, service descriptions and original platform content are protected by applicable intellectual-property laws. Except as allowed by law or written permission, you may not copy, scrape, reverse engineer, bypass security, misuse trademarks or use the service to build a competing dataset. Feedback may be used without restriction or payment, but it will not be attributed publicly without permission.
13. Service availability and liability
DaoJoy aims to provide reliable services but does not promise uninterrupted availability. Maintenance, network failures, third-party systems, weather, public measures and events beyond reasonable control may affect the service. We will use reasonable efforts to restore service and support affected bookings.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, intentional misconduct, gross negligence or personal injury where applicable. Subject to mandatory law, each party is responsible for reasonably foreseeable loss caused by its breach and must take reasonable steps to limit avoidable loss. DaoJoy is not responsible for an independent participant’s conduct merely because the platform enabled contact, but this does not reduce any duty or platform liability imposed by law.
14. Governing law, complaints and language
Contact hello@daojoy.com first so we can investigate and preserve the relevant order record. You may also use any consumer complaint, mediation, arbitration or court remedy available under applicable law. The final published Terms and the applicable operator or transaction disclosure must identify any selected governing law and dispute forum. Until that information is approved and displayed, this review draft does not impose an exclusive governing law, arbitration requirement or venue. Mandatory protections and courts that cannot lawfully be excluded remain available.
English and Simplified Chinese versions are intended to have the same meaning. The final published Terms must state the controlling-language rule, subject in every case to mandatory law.
15. Changes and contact
DaoJoy may update these Terms for legal, safety or product reasons. We will identify the new version and effective date and provide any notice or renewed acceptance required by law before a material change applies. Changes do not retroactively alter an accepted order snapshot unless required by law or expressly agreed.
